26/7/07: Feedback on PN SC 7 of 2006 - Use of Technology in Litigation

Dear colleagues,
Those of us engaged in litigation are familiar with the
rise of e-discovery and its associated challenges and cost pressures for litigation practitioners.
In light of this, the Victorian Practice Note regarding
use of technology in civil litigation was recently updated. In addition, the Federal Court of Australia is now
reviewing their relevant practice note.
The Supreme Court of New South Wales is also conducting an internal review of PN SC7 of 2006 - Use of Technology and is interested in receiving feedback from practitioners or others with an interest in the area. A special meeting of the Society has been convened for the purpose of gathering that feedback from members on Thursday, 26 July at 12:30pm at the offices of Clayton Utz at L34, 1 O'Connell Street, Sydney.
The meeting will be facilitated by legal technology consultants, Potter Farrelly & Associates, who are assisting in providing feedback for the court. This link is to a document which sets out feedback gathered to date. This document will be used as a framework for gathering feedback at the meeting. Please also look at the link to the current practice note available at lawlink.nsw.gov.au Given Chief Justice Spigelman's recent comments "that the present burden of the cost of discovery in commercial litigation is more than the commercial community is likely to tolerate", members are strongly encouraged to take this opportunity to provide feedback on the current practice
note.
